Terms of Use
Agreement and who we are
These Terms of Use are an agreement between you and Yester (“Yester”, “we”, “us”), which operates the Yester app and getyester.com from Colorado, United States. By creating an account or using Yester, you agree to these terms and acknowledge our Privacy Policy. If you do not agree, do not use Yester. Contact us at hi@getyester.com about these terms, support or rights concerns.
Who can use Yester
You must be at least 13 years old, or older if your country sets a higher minimum age to use online services without a parent’s consent. If you are under 18, a parent or guardian should review these terms with you. Some stories describe war, violence, disease, slavery and other difficult events from history.
A free service
Yester is currently free. There are no subscriptions, automatic renewals or in-app purchases in this release, and signing in does not authorize any charge. Your carrier or internet provider may charge for data. Any future paid feature would be offered separately, with its price and terms shown before you agree.
Your account
Sign in with Apple or Google identifies your account and lets you save stories, take quizzes and keep your results. Keep your sign-in account secure and tell us if you believe your Yester account has been misused. Do not impersonate anyone or use another person’s account. You can stop using Yester at any time and delete your account in the app under Account management.
History for learning, not advice
Yester offers short historical articles and quizzes for general information and learning. Articles are researched from several sources, may be drafted, edited or translated with AI assistance and are reviewed before publication, but they are summaries, not primary records, and may contain errors, omissions or debated interpretations. Listed sources are references for further reading; a source does not endorse Yester or support every sentence. Verify anything important with original materials. Nothing in Yester is legal, medical, financial or other professional advice. Quiz scores are for fun and learning and have no monetary or other value. Report corrections through Feedback or hi@getyester.com.
Our content and your license
Yester’s original articles, headings, quizzes, design, name and logo belong to Yester or its licensors. Articles are original writing based on several sources; we do not republish the text of those sources. We do not claim ownership of historical facts, public-domain works or material that others license openly. We grant you a personal, non-exclusive, non-transferable and revocable license to use Yester for your own non-commercial reading and learning. You may share links and the share images the app creates, with their credits intact. You may not copy or republish our articles or quizzes in bulk, scrape or download the catalog by automated means, use our content to build a competing service or to train AI models, reverse engineer the app, bypass security or rate limits, disrupt the service, or use Yester for anything unlawful.
Images and third-party material
We only use images that are in the public domain or offered under licenses that allow our use, such as CC0 and Creative Commons Attribution, and we credit the creator, license and source in Photo info and on share images. An image may show a person, place or period related to a story rather than the exact event, and covers are cropped to fit the app. Wikimedia Commons and other archives host images but do not license every image themselves. Openly licensed material remains under its own license, which takes priority over these terms for that material. A public-domain or open license does not necessarily clear privacy, publicity or trademark rights. If you reuse an image, follow its license and keep its credit.
Copyright and rights complaints
We respect intellectual property, privacy and other rights. If you believe material in Yester infringes your rights, use Report in Photo info or email hi@getyester.com with: the work or right concerned; the story or image in Yester; your name and contact details; a statement that you believe in good faith the use is not authorized by the owner, its agent or the law; and a statement that your notice is accurate and that you are the owner or authorized to act for the owner. We review every complete notice promptly and may remove, replace or restrict material while we do. If your material was removed and you believe it was a mistake, reply with your explanation and we will reconsider.
Feedback
Feedback is sent privately to Yester and is not posted publicly. Send only what you are entitled to share and never passwords or sensitive personal information. If you send ideas or suggestions, we may use them to improve Yester without obligation to you. This does not give us ownership of your personal information or permission to publish your message.
Third-party services and links
Yester relies on third-party services, including Apple, Google and the archives and websites cited as sources. Their own terms and privacy policies apply when you use them or follow a link. We are not responsible for third-party websites, services or content.
Changes, availability and ending use
We may add, change, correct or remove features and content, and may suspend or end the service, with notice where reasonable. We may suspend or close an account that breaks these terms, abuses the service or creates legal risk, and we will tell you when we can. You may stop using Yester and delete your account at any time. Sections that by their nature should survive, such as ownership, disclaimers, limits of liability and disputes, continue after your use ends.
Disclaimers
To the fullest extent permitted by law, Yester is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation.
Limitation of liability
To the fullest extent permitted by law, Yester will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, arising from or related to your use of, or inability to use, Yester. Our total liability for all claims relating to Yester is limited to the greater of the amount you paid us in the 12 months before the claim (zero for the free app) or 50 US dollars. These limits do not apply where the law does not allow them, for example to liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence.
Your responsibility
To the extent permitted by law, you agree to defend and compensate Yester for claims, losses and reasonable costs, including legal fees, that result from your breach of these terms or your unlawful use of Yester.
Governing law and disputes
These terms are governed by the laws of the State of Colorado and applicable United States federal law, without regard to conflict-of-law rules. Before filing a claim, please email hi@getyester.com and give us 30 days to try to resolve it informally. Any dispute that is not resolved will be decided by the state or federal courts located in Colorado, and you and Yester consent to their jurisdiction. Either party may bring an individual claim in small-claims court instead. If you are a consumer living outside the United States, you keep the protection of the mandatory laws of your country and may bring a claim in your local courts.
Apple App Store terms
If you downloaded Yester from the Apple App Store: these terms are between you and Yester only, not Apple, and Yester, not Apple, is responsible for the app and its content. Your license is limited to using the app on Apple-branded devices you own or control, as allowed by the App Store’s Usage Rules. Apple has no obligation to provide maintenance or support. Because the app is free, Apple has no warranty obligation to you; to the extent permitted by law, Apple has no other warranty obligation for the app. Yester, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, privacy and intellectual-property claims. You confirm you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
General terms
These terms and the Privacy Policy are the entire agreement between you and Yester about the service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these terms; we may transfer ours as part of a reorganization, merger or sale of the service, with notice to you. The English version governs if a translation differs.
Changes to these terms
We will publish revised terms with a new date and give appropriate notice of material changes, in the app or by email. Changes apply from their effective date and never authorize charges retroactively. If you keep using Yester after changes take effect, the new terms apply; if you do not agree, stop using Yester and delete your account.
